These Terms of Service govern your access to and use of Your New Team. By using our website or services, you agree to these terms.

Agreement

These Terms form an agreement between you and Your New Team, a California sole proprietorship owned and operated by David Wilch. If you are using the service on behalf of a business, you represent that you have authority to bind that business to these Terms.

Service description

Your New Team provides AI employees that help businesses communicate with customers through supported communication channels such as phone, SMS, and other supported messaging experiences. Our AI employees can help answer inquiries, capture lead information, support appointment workflows, and assist with customer follow-up based on the configuration and knowledge you provide.

Features may change over time as we improve the product. Some capabilities may depend on your plan, enabled integrations, or channel configuration.

Accounts and eligibility

You must provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account.

The service is intended for lawful business use. You may not use Your New Team if doing so would violate applicable law or these Terms.

Acceptable use

You agree not to use the service to:

  • Violate any applicable law, regulation, or third-party right
  • Send spam, unlawful messages, deceptive communications, or unsolicited marketing that violates carrier or messaging rules
  • Impersonate another person or business in a misleading or fraudulent way
  • Attempt to disrupt, probe, reverse engineer, or gain unauthorized access to the service or related systems
  • Upload or transmit malware, harmful code, or content intended to interfere with the platform
  • Use the service for emergency dispatch, medical advice, legal advice, or other high-risk activities it is not designed to handle

Customer responsibilities

You are responsible for how your business uses Your New Team, including the accuracy of business knowledge you provide, the instructions and policies you configure, and compliance with laws that apply to your communications with customers.

This includes obtaining any required consents or providing required notices for calls, recordings, SMS, and other messaging where applicable. You are also responsible for reviewing important outcomes, handling escalations, and ensuring your team uses the platform appropriately.

SMS messaging

Where SMS messaging is enabled, messages are sent only after appropriate consent is obtained. SMS messages may include customer-care, appointment-related, account-notification, and service-related communications where applicable.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for assistance. Consent to receive SMS messages is not a condition of purchase.

AI limitations

AI employees can misunderstand requests, miss context, or produce incomplete responses. Your New Team does not guarantee that every interaction will be perfect, uninterrupted, or free from error.

You should configure clear guidance, monitor performance, and use human review where decisions are important. Do not rely on the service as a substitute for professional judgment in legal, medical, financial, safety-critical, or similarly sensitive matters.

Availability

We work to keep the service reliable, but we do not guarantee uninterrupted or error-free availability. Maintenance, provider outages, network issues, and events beyond our reasonable control may affect performance.

We may modify, suspend, or discontinue features when needed to maintain security, improve the product, or comply with legal or provider requirements.

Intellectual property

Your New Team and its software, branding, documentation, and related materials are owned by David Wilch / Your New Team or its licensors. These Terms do not transfer ownership of our intellectual property to you.

You retain ownership of the business content and materials you provide. You grant us a limited license to host, process, and use that content as needed to operate and improve the service for your account.

Payments

Paid plans, usage-based charges, or subscription fees may apply to your use of Your New Team. Pricing, billing intervals, and included features are described at the time of purchase or in your account materials.

By purchasing a paid offering, you authorize applicable charges for the selected plan and any agreed add-ons. Fees are generally non-refundable except where required by law or expressly stated otherwise. We may change pricing with notice for future billing periods.

Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these Terms, create risk for the platform or others, fail to pay applicable fees, or if we need to do so for legal, security, or operational reasons.

Upon termination, your right to use the service ends. Provisions that by their nature should survive termination, including intellectual property, limitation of liability, and governing law, will continue to apply.

Limitation of liability

To the maximum extent permitted by law, Your New Team and David Wilch are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or cost of substitute services, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability arising out of or related to the service or these Terms is limited to the amounts you paid to Your New Team for the service in the twelve months before the claim arose, or one hundred U.S. dollars if you have not paid any amounts.

Disclaimer

The service is provided on an “as is” and “as available” basis. Except as expressly stated in these Terms, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Courts located in California will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the service, except where applicable law requires otherwise.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date and post the updated Terms on this page. Continued use of the service after changes become effective constitutes acceptance of the updated Terms.
